2. CAAN Regulatory Documentation & Compliance Architecture
The Civil Aviation Authority of Nepal regulates civil aviation under the Civil Aviation Authority of Nepal Act, 2053 (1996) and Civil Aviation Regulations, 2058 (2002). Operational and technical enforcement is executed through dedicated statutory publications.

└─────────────────────────────────────────────────────────────┘2.1 Civil Aviation Requirements (Key CAR Publications)
CAR-19 (Safety Management System Requirements):
- Direct transposition of ICAO Annex 19.
- Mandates an approved SMS for all commercial air operators (AOC holders), approved maintenance organizations (CAR-145), certified aerodromes, and ATS service providers.
- Requires safety risk management (SRM), mandatory safety reporting (MOR), voluntary non-punitive safety reporting (VSR), and defined Safety Performance Indicators (SPIs).
CAR-M (Continuing Airworthiness Management):
- Sets standards for operator Continuing Airworthiness Management Organizations (CAMO).
- Governs aircraft maintenance programs (AMP), Airworthiness Directives (AD) compliance, reliability monitoring, and maintenance record retention for the
9N-register.
CAR-145 (Approved Maintenance Organizations):
- Certification and oversight criteria for line and base maintenance facilities servicing turboprop, turbojet, and rotor-wing airframes in Nepal.
CAR-66 & CAR-147 (Certifying Staff & Training Organizations):
- Syllabi, licensing exams, and type ratings for Aircraft Maintenance Engineers (AME) across categories A, B1, B2, and C.
Flight Operations Requirements (FOR-A & FOR-H):
- FOR-Aeroplane: Transposes Annex 6 Part I & II. Governs airline and STOL commercial transport, fuel policy (final reserve + diversion fuel), minimum flight crew qualifications, and flight time limitations (FTL/FDP).
- FOR-Helicopter: Transposes Annex 6 Part III. Governs commercial passenger charters, sling operations, high-altitude rescue procedures, and Performance Class 1/2 profiles.
2.2 State Safety Programme (SSP) Nepal
The State Safety Programme (SSP) Nepal represents the integrated set of regulations and activities aimed at improving aviation safety at the State level, organized into four primary components:
- Component 1: State Safety Policy, Objectives, and Resources:
- Establishes national safety legislative frameworks, primary aviation legislation, CAAN regulatory structure, and inspectorate staffing and training.
- Component 2: State Safety Risk Management:
- Defines safety requirements for service providers' SMS, national hazard identification registries, and sector-specific risk profiling.
- Component 3: State Safety Assurance:
- Continuous safety surveillance, regulatory compliance audits, safety data collection and analysis, and targeted enforcement based on risk.
- Component 4: State Safety Promotion:
- Internal and external training, safety data exchange, and fostering a Just Culture throughout the Nepalese aviation community.
2.3 National Aviation Safety Plan (NASP) Nepal
The NASP (current edition aligned with ICAO GASP 2023–2028) outlines strategic national safety goals to achieve an Acceptable Level of Safety Performance (ALoSP).
Priority High-Risk Categories of Occurrences (HRCs) in Nepal:
- Controlled Flight Into Terrain (CFIT):
- Focus: High-elevation VFR operations, valley obscuration, and non-precision mountain approaches.
- Mitigations: Mandatory Enhanced Ground Proximity Warning Systems (EGPWS / TAWS Class A/B), terrain clearance monitoring, and CFIT education.
- Loss of Control - Inflight (LOC-I):
- Focus: Severe mountain lee-wave turbulence, icing in convective clouds, and low-speed handling at high density altitude.
- Mitigations: Mandatory Upset Prevention and Recovery Training (UPRT) for transport aircrews.
- Runway Excursion (RE) & Abnormal Runway Contact (ARC):
- Focus: Short, sloped STOL runways (e.g. Lukla 527m at 11.7% gradient, Jomsom crosswinds), wet runway contamination during monsoon season.
- Mitigations: Strict go-around criteria before commit points, stabilized approach SOP enforcement, and runway friction monitoring.
2.4 Aviation Enforcement Policy and Procedure Manual (AEPPM)
CAAN's Aviation Enforcement Policy and Procedure Manual (AEPPM) governs the statutory processes applied when non-compliance, regulatory infractions, or safety breaches occur:
- Just Culture Matrix: Differentiates between honest human errors, slips/lapses, and willful misconduct or reckless disregard of flight safety rules.
- Enforcement Action Spectrum:
- Administrative Action: Warning letters, correction notices, and mandatory corrective action plans (CAP).
- Remedial Action: Directed re-training, simulator re-checks, and operational supervision periods.
- Legal / Certificate Action: Suspension or revocation of Pilot Licenses (CPL/ATPL), Engineer Licenses (AME), or Air Operator Certificates (AOC).
- Financial Penalties: Statutory fines issued under Civil Aviation Act provisions.
2.5 Mountain-Flying Operational Directives & Guidelines
Due to extreme topography, rapid weather shifts, and high-density altitudes, CAAN enforces specialized operational directives:
- VFR En-Route Weather Minima in Mountainous Sectors:
- VFR flights are strictly prohibited when forward flight visibility drops below 5 km or cloud ceiling is less than 1,500 ft AGL in valley passes.
- Strict adherence to the "No Visual Contact with Terrain, No Flight" standard; entering clouds under VFR is an actionable violation.
- Special Aerodrome Qualification (STOL Airfields):
- Aerodromes categorized as Critical / Mountain STOL (e.g., Tenzing-Hillary Airport VNLK / Lukla, Jomsom VNJS, Simikot VNST, Talcha/Rara VNRR) require special PIC sign-offs.
- Requirements: Minimum of 100 STOL operational hours, mandatory line training flights with designated instructor pilots, and designated captain-only landing authority.
- Monsoon Standard Operating Procedures (SOP):
- Enforced annually between June and September.
- Requires live en-route and destination weather observation confirmation before engine start.
- Destination terminal weather cannot be assumed; if pass weather deteriorates, immediate 180° turnaround is mandatory prior to entering narrow valleys.
- Commercial Helicopter Operations Mountain Directives:
- Mandatory dual-pilot operation for commercial passenger charters and VIP flights operating in mountainous high-elevation zones.
- Requirement for real-time satellite flight tracking and ADS-B monitoring by operator flight operations control (FOC).
- Mandatory Performance Class 1 or Class 2 operating limits adhering to altitude-temperature-weight graphs with safety power reserves.
